Terms of Service

1. Acceptance of Terms
By accessing and using the Nasta mobile application ("App", "Platform", "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.
2. Description of Service
Nasta is a marketplace platform that connects individual service providers (job seekers, freelancers, contractors) with individual clients seeking services. The Platform facilitates:
- Job posting and application management
- Service provider discovery and matching
- Secure payment processing through Stripe
- Identity verification (KYC), background checks, vehicle and driver license verification
- Booking and scheduling management
- In-app messaging and chat
- Support ticketing and abuse reporting
Nasta serves **individuals only**. The Platform is not intended for company-to-company transactions, recruitment for permanent employment, or business-entity verification.
3. User Accounts and Registration
3.1 Account Creation
- You must provide accurate, current, and complete information during registration
- You must be at least 18 years old to use the Platform
- You are responsible for maintaining the confidentiality of your account credentials
- You agree to accept responsibility for all activities that occur under your account
- One account per individual — multiple or duplicate accounts are not permitted
3.2 Account Types
- **Clients**: Individuals who post jobs and hire service providers
- **Service Providers**: Individuals who offer services and apply for jobs
- **Admins**: Platform administrators with specific capabilities
3.3 Verification Requirements
- Identity verification (KYC) is mandatory for all service providers
- Background checks are required for all service providers
- Additional verifications may be required depending on the job category (see Section 7)
- Failure to complete verification will restrict access to Platform features
4. Platform Rules and Prohibited Conduct
4.1 Prohibited Activities
You agree NOT to:
- Post false, misleading, or fraudulent information
- Engage in harassment, discrimination, or hate speech
- Solicit services or payments outside the Platform
- Share personal contact information before a booking is confirmed
- Use the Platform for illegal activities
- Impersonate another person
- Interfere with or disrupt the Platform's operation
- Attempt to gain unauthorized access to any part of the Platform
- Use automated systems to scrape or collect data
- Violate any applicable local, national, or international law
4.2 Content Standards
- Job postings must be accurate and comply with all applicable laws
- Service provider profiles must reflect true qualifications and experience
- Reviews and ratings must be honest and based on actual service delivery
- False reviews or ratings are strictly prohibited
5. Payments and Financial Terms
5.1 Payment Processing
- All payments are processed through Stripe, a third-party payment processor
- Funds are held securely in Stripe escrow until the job is confirmed complete
- Nasta does not hold funds directly
- Payment processing is subject to Stripe's terms and conditions
5.2 Payment Timeline
- **For Clients**: Payment is charged immediately upon booking confirmation and held in escrow
- **For Service Providers**: Payment is released after the client confirms job completion, typically arriving in your account within 2-5 business days
- Payment disputes must be reported before the job is confirmed complete
5.3 Fees
- Platform fees are clearly disclosed before booking confirmation
- Service providers receive payment minus applicable platform fees
- Platform fees are non-refundable except in cases of no-show or verified platform error
5.4 Refunds and Cancellations
Refund handling is described in detail in our **Refund Policy**. In summary:
- Full automatic refunds are issued for verified service-provider no-shows
- Cancellations made before the verification code is activated receive a full refund
- Disputes outside automatic refunds are handled through the Platform's support system
6. Off-Platform Transactions
6.1 Prohibited Off-Platform Transactions
**IMPORTANT**: All transactions, communications, and agreements must occur within the Nasta Platform. Any attempt to conduct business outside the Platform is strictly prohibited and may result in immediate account termination.
6.2 Nasta is NOT responsible for:
- Any equipment, tools, or materials purchased outside the Platform
- Any services arranged or paid for outside the Platform
- Any agreements or arrangements made outside the Platform
- Any disputes arising from off-platform transactions
- Any financial losses from off-platform activities
6.3 Consequences of Off-Platform Agreements
Users who engage in off-platform transactions may face:
- Immediate account suspension or termination
- Loss of access to Platform features and protections (including escrow and dispute resolution)
- Reporting to relevant authorities where applicable
Off-platform agreements are not protected by Nasta's dispute resolution process and users do so at their own risk.
7. Identity, Background, Vehicle and Driver License Verification
7.1 Identity Verification (KYC)
- Service providers must complete identity verification using a government-issued ID and a selfie
- Verification documents are securely stored and encrypted
- Verification status is displayed on user profiles
7.2 Background Check
- A criminal background check is required for all service providers
- Service providers must upload an official background check document during onboarding
- Nasta reviews submissions and may request a re-check or reject inaccurate documents
7.3 Vehicle Verification
For job categories that involve transportation, deliveries, or driving (such as moving, courier, ride-related services), the service provider must complete **vehicle verification**:
- Upload clear photos of the vehicle (front, back, sides, license plate)
- Provide vehicle registration documents
- Vehicle must be in safe, road-legal condition
- Nasta may reject vehicles that are unsafe, unregistered, or do not match submitted documents
7.4 Driver License Verification
For any driving-related job category, the service provider must complete **driver license verification**:
- Upload clear photos of the front and back of a valid driver license
- The driver license **must be at least 3 years old** (issued at least 3 years before the date of submission)
- The license must be valid (not expired, suspended, or revoked)
- Nasta may reject licenses that do not meet the age requirement, are expired, or appear tampered with
7.5 Verification Accuracy and Limits
- Nasta verifies information to the best of its ability but does not guarantee accuracy
- Users are responsible for providing accurate information
- False or fraudulent information may result in immediate account termination and potential legal action
8. Job Postings and Applications
8.1 Job Postings
- Clients are responsible for accurate job descriptions
- Job postings must comply with all applicable laws
- Clients must respond to applications in a timely manner
- False or misleading job postings are prohibited
8.2 Applications
- Service providers may apply for multiple jobs
- Applications must be truthful and accurate
- Service providers may withdraw applications at any time
- Clients may reject applications at their discretion
9. Bookings and Service Delivery
9.1 Booking Process
- Bookings are confirmed when both parties agree and payment is held in escrow
- Service providers must arrive on time and check in using the verification code provided by the client
- Clients must provide accurate job requirements and location
- Changes to bookings must be agreed upon by both parties
9.2 Service Standards
- Services must be delivered as described in the job posting
- Service providers must have necessary skills, tools, and equipment
- Clients must provide a safe working environment
- Both parties must communicate clearly and professionally through the Platform
10. Dispute Resolution
10.1 Internal Resolution
- Disputes should first be resolved through direct communication on the Platform
- If unresolved, disputes may be escalated to Nasta support
- Support tickets are reviewed by our team within 24-48 hours
- Decisions are made based on available evidence (verification code records, job movement history, communication history) and platform policies
10.2 Mediation
- For complex disputes, Nasta may offer mediation
- Mediation is voluntary and both parties must agree to participate
11. Abuse Reporting and Penalties
11.1 Reporting Abuse
- Users can report abuse, harassment, or violations through the Platform
- Reports are reviewed by our safety team
- False reports may result in penalties for the reporting user
11.2 Penalties for Violations
Violations of these Terms may result in:
- **Warning** for first-time minor violations
- **Temporary Suspension** of 7-30 days for repeated violations
- **Permanent Ban** for serious violations or repeated offenses
- **Legal Action** for illegal activities or fraud
- **Financial Penalties** for payment-related violations
11.3 Types of Violations
- Harassment, discrimination, or hate speech
- Fraud or misrepresentation
- Off-platform transactions
- Payment fraud or chargebacks
- Identity, background, vehicle, or driver license verification fraud
- Spam or unsolicited communications
- Violation of privacy or data protection
12. Intellectual Property
12.1 Platform Content
- All content on the Platform is owned by Nasta or its licensors
- Users may not copy, modify, or distribute Platform content without permission
12.2 User Content
- Users retain ownership of content they post
- By posting content, users grant Nasta a worldwide, non-exclusive license to use, display, and distribute the content within the Platform
- Users are responsible for ensuring they have rights to any content they post
13. Privacy and Data Protection
Your use of the Platform is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.
14. Limitation of Liability
14.1 Platform Liability
- Nasta provides the Platform "as is" without warranties
- We do not guarantee uninterrupted or error-free service
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid in fees in the 12 months preceding the claim
14.2 User Liability
- Users are responsible for their own actions and content
- Users are liable for any damages caused by violations of these Terms
- Users must indemnify Nasta against claims arising from their use of the Platform
15. Termination
15.1 By User
- Users may terminate their account at any time from the in-app account settings
- Account deletion requests are processed promptly
- Outstanding payments and active bookings must be resolved before account deletion
15.2 By Nasta
- We may suspend or terminate accounts for violations of these Terms
- We may terminate accounts that are inactive for extended periods
- Termination does not relieve users of outstanding obligations
16. Changes to Terms
- We may update these Terms at any time
- Material changes will be notified through the App
- Continued use after changes constitutes acceptance
- Users who do not agree to changes must stop using the Platform
17. Governing Law and Jurisdiction
- These Terms are governed by the laws of Portugal
- Disputes will be resolved in the courts of Portugal
- Users agree to submit to the jurisdiction of Portuguese courts

19. Severability
